Terms of Service

1. Agreement

By accessing or using LearnerLens, you agree to these Terms of Service. If you use the service on behalf of a school, you confirm that you have authority to bind that school.

2. POPIA roles and school obligations

Each school using LearnerLens is the responsible party under POPIA for learner personal information it uploads or controls. The school must:

• Obtain parental consent before uploading learner data where required by law
• Appoint or designate an Information Officer and make contact details available to parents
• Ensure data uploaded is accurate, relevant, and limited to what is necessary
• Not share staff login credentials between users
• Respond to data subject requests relating to learner records under its control

3. Operator relationship

LearnerLens acts as an operator and processes personal information only on the school's documented instruction. Before production use, each school must enter into a written operator or data processing agreement with LearnerLens, as required by POPIA section 21.

Schools instruct LearnerLens to store and process data on Google Cloud infrastructure in the Netherlands (europe-west4), as described in our Privacy Policy.

4. Parent accounts

Parents may self-register by creating an account on the login page. Registration requires acceptance of the Privacy Policy and consent to processing as described there.

Parents link to their children using a school-issued invite code. A parent may only access results for children they are authorised to view.

5. Subscription and billing

Schools subscribe via Stripe on a tiered per-learner basis. Active learner count is synced automatically. Non-payment may result in read-only access after a grace period.

Billing applies to school subscriptions only. Parent and learner portal access does not require separate payment through LearnerLens.

6. Acceptable use

• Use the platform only for lawful school and educational purposes
• Do not publish results or teacher notes outside the platform without proper consent
• Do not attempt to access data belonging to other schools, learners, or parents
• Do not interfere with platform security or availability

7. Data protection

Personal information is handled as described in our Privacy Policy. Authorised school administrators may export or delete learner data through dashboard tools where their role permits.

LearnerLens implements technical and organisational measures appropriate to the nature of the data processed, but schools remain responsible for the lawfulness of data they provide and instructions they give.

8. Limitation, changes, and contact

LearnerLens is provided to schools on an "as available" basis. To the extent permitted by law, we are not liable for indirect or consequential loss arising from use of the service. Nothing in these terms limits rights that cannot be excluded under POPIA or other applicable law.

We may update these terms from time to time. Continued use after an update constitutes acceptance of the revised terms, subject to any requirements under applicable law.
